ALERT AVAILABLE ON TRUCKLINE
An updated Owner-Operator Classification Alert on state
legislative activity affecting independent contractors is now available on the ATA Truckline
website. The Alert
can be found under the Priority Policy Issues bar on the Truckline
home page and is accessible only to ATA members.
State legislative sessions are now in full swing and things are heating
up quickly on independent contractor issues. The Feb. 2008 Alert
provides new updates on 23 different legislative proposals from 17 states.
Unfortunately, most of the provisions focus on alleged employee
misclassification problems and the creation of greater scrutiny of independent
contractor status. Other provisions of interest include an Illinois proposal
defining independent contractor status specifically in the trucking industry
and Miss. legislation that eliminates the general presumption of employee
status in applying the State’s Workers’ Compensation Act. Contact
